Waste Removal Ealing Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Ealing provides waste collection and related services to domestic and commercial customers. By making a booking, using our services, or permitting our operatives to access your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, company or organisation that requests or receives services from Waste Removal Ealing.

Services means any waste removal, rubbish clearance, collection, loading, transportation, recycling or disposal service provided by Waste Removal Ealing.

Premises means the address or location where the waste is to be collected or at which the Services are to be performed.

Waste means any materials, items, rubbish or refuse that the Customer instructs Waste Removal Ealing to collect, subject to applicable regulations and any exclusions stated in these Terms and Conditions.

2. Scope of Services

Waste Removal Ealing provides waste collection and removal services for household, garden, commercial and similar non-hazardous waste. The specific scope of work for each booking will be agreed during the quotation or booking process and may include loading, carrying, and lawful disposal or recycling of the agreed Waste.

We reserve the right to refuse to collect or handle any Waste that we reasonably believe to be hazardous, illegal, contaminated, excessively heavy, or otherwise unsuitable for our standard collection services. This includes, but is not limited to, asbestos, certain chemicals, medical waste, gas bottles, and pressurised containers.

3. Booking Process

3.1 Bookings may be made by telephone, email, or any booking form or system that we may make available. When you place a booking request, you confirm that you have the authority to do so and that the information you provide is accurate and complete.

3.2 We may provide an estimate based on information you supply, including descriptions of the volume, type and location of the Waste. All estimates are subject to our inspection of the Waste on arrival at the Premises.

3.3 Your booking will be treated as confirmed only when we have acknowledged it and provided an agreed date or time slot. We reserve the right to decline any booking request at our discretion.

3.4 We will make reasonable efforts to attend the Premises at the agreed time or within the agreed time slot, but all times are estimates only and are not guaranteed. We accept no liability for any loss or inconvenience caused by delays or rescheduling, except as expressly stated in these Terms and Conditions.

4. Access and Customer Obligations

4.1 The Customer must ensure that safe and suitable access to the Premises is available at the agreed time of collection. This includes arranging any necessary permissions, parking provisions, or entry arrangements.

4.2 The Customer is responsible for ensuring that the Waste to be collected is clearly identified and separated where necessary. If any special instructions are required, these must be provided in advance.

4.3 If our operatives are unable to access the Premises, or if access is significantly obstructed or unsafe, we may at our discretion cancel or postpone the Service and charge a call-out or wasted journey fee.

4.4 You must not include in the Waste any materials that are prohibited by law or by these Terms and Conditions. You agree to indemnify Waste Removal Ealing for any loss, damage, fine, or claim arising from your inclusion of prohibited or misdescribed items in the Waste.

5. Estimates, Pricing and Quotations

5.1 Any quotation or estimate provided prior to our arrival is based on the information you provide and is not binding until we have inspected the Waste in person.

5.2 On arrival at the Premises, our operatives will assess the volume, weight, access conditions and type of Waste. If these differ substantially from your original description, we may revise the price accordingly.

5.3 If you do not agree with a revised price, you may decline the Service at that point. However, we reserve the right to charge a reasonable attendance fee to cover our costs of travel and time.

5.4 All prices are stated in pounds sterling and may be subject to applicable taxes. We will confirm whether prices are inclusive or exclusive of any such taxes at the time of booking.

6. Payments

6.1 Payment is due in full on completion of the Service, unless otherwise agreed in writing prior to the Service. For commercial Customers with approved credit terms, payment is due within the period specified on the invoice.

6.2 We may accept payment by cash, bank transfer, or card payment, subject to availability of payment facilities and any conditions notified to you at the time of booking.

6.3 If payment is not received in accordance with these Terms and Conditions, we reserve the right to charge interest on any overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing payment.

6.4 Title to any collected Waste transfers to Waste Removal Ealing only upon full payment of all sums due in respect of the Service.

7. Cancellations and Amendments

7.1 You may cancel or amend your booking by giving us reasonable notice prior to the agreed collection time. We request at least 24 hours notice for cancellations or significant changes.

7.2 If you cancel with less than 24 hours notice, or if our operatives attend the Premises and are unable to carry out the Service for reasons outside our control, we may charge a cancellation or wasted journey fee.

7.3 We may cancel or reschedule a booking if we are affected by events beyond our reasonable control, including but not limited to extreme weather, traffic incidents, vehicle breakdowns, staff illness, or legal restrictions. In such circumstances, we will aim to notify you as soon as possible and offer an alternative appointment.

7.4 If we cancel a booking and are unable to offer a suitable alternative time, any advance payments made by you in respect of the cancelled Service will be refunded.

8. Waste Handling and Regulations

8.1 Waste Removal Ealing will handle, transport and dispose of Waste in accordance with applicable UK legislation and regulations relating to waste management, including duty of care requirements.

8.2 By using our Services, you confirm that you are the owner of the Waste or have full authority from the owner to arrange for its removal and disposal.

8.3 You agree to provide accurate information about the type and origin of the Waste and to cooperate with any documentation that may be legally required in connection with its collection and disposal.

8.4 Where a waste transfer note or similar documentation is required by law, we will prepare or issue such documentation as appropriate. You must retain your copy of any such document as part of your own legal obligations.

8.5 We aim to divert Waste from landfill wherever reasonably possible by using licensed recycling and recovery facilities. However, we do not guarantee that all Waste will be recycled, and the method of treatment or disposal will be determined at our discretion in compliance with regulations.

9. Customer Property and Site Condition

9.1 The Customer must take reasonable steps to protect driveways, paths, surfaces and property at the Premises prior to the commencement of the Service. This includes, where appropriate, moving vehicles, protecting delicate surfaces, and removing fragile items from working areas.

9.2 Our operatives will handle items with reasonable care, but Waste Removal Ealing is not responsible for normal wear, tear or disturbance resulting from the lifting and carrying of heavy or bulky items through restricted or difficult access routes.

9.3 If you request that we carry out work in a manner that we advise is likely to risk damage, we may require you to confirm this in writing, and our liability for any resulting damage may be limited as described in these Terms and Conditions.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be limited or excluded.

10.2 Subject to the above, Waste Removal Ealing shall not be liable for any indirect, consequential or special loss or damage, or for loss of profits, revenue, business, contracts, or anticipated savings, whether arising in contract, tort, or otherwise.

10.3 Our total aggregate liability to you in respect of any claim arising out of or in connection with the Services shall not exceed the total price paid or payable for the specific Service giving rise to the claim.

10.4 We are not liable for any loss or damage arising from inaccurate, incomplete or misleading information provided by the Customer, nor for any items removed as Waste where those items were not clearly identified as to be retained.

10.5 You must notify us in writing of any claim or complaint relating to the Services within seven days of completion of the Service or, in the case of latent damage, within a reasonable time of becoming aware of the issue. We may inspect the Premises or request further information before reaching a decision on any such claim.

11. Insurance

11.1 Waste Removal Ealing maintains public liability insurance and other insurances appropriate to the nature of its operations. Details of our insurance cover are available on request.

11.2 Our insurance coverage is subject to policy terms, conditions and exclusions. These Terms and Conditions do not extend or modify the scope of any insurance policy.

12. Data Protection and Privacy

12.1 We will collect and use your personal information for the purposes of administering bookings, providing Services, processing payments, and managing our relationship with you.

12.2 We will handle personal data in accordance with applicable data protection laws and our internal procedures. We will not sell your personal information to third parties.

12.3 We may share your information with trusted third parties where necessary to provide the Services, comply with legal obligations, or enforce our rights.

13. Health and Safety

13.1 Both Waste Removal Ealing and the Customer agree to take reasonable steps to ensure the health and safety of all persons present at the Premises during the Service.

13.2 Our operatives may refuse to carry out any activity that they reasonably consider to be unsafe or in breach of health and safety regulations. In such cases, we will discuss alternative options where possible.

14. Suspension and Termination

14.1 We may suspend or terminate the provision of Services to you with immediate effect if you materially breach these Terms and Conditions, if you fail to make payment when due, or if we reasonably believe that your continued engagement would expose us to legal or reputational risk.

14.2 Termination shall not affect any rights or obligations that have accrued up to the date of termination, including any right to receive payment for Services already performed.

15. Variations to Terms

15.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to Services booked after the date on which the revised Terms and Conditions are published or otherwise notified to you.

15.2 For ongoing commercial arrangements, we will notify you of any material changes to these Terms and Conditions and, where required, seek your agreement.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by Waste Removal Ealing in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

17.3 These Terms and Conditions constitute the entire agreement between Waste Removal Ealing and the Customer in relation to the Services and supersede any prior discussions, correspondence or arrangements.

17.4 Nothing in these Terms and Conditions is intended to confer any rights on any person who is not a party to them.
